The Individuals with Disabilities Education Act (IDEA) require all States to establish and maintain an advisory panel for the purpose of providing policy guidance with respect to special education and related services for children with disabilities (34 C.F.R. §§300.167). In compliance with IDEA, the District of Columbia established the panel through the Mayor’s Order 2004-187 issued November 16, 2007 and updated on November 13, 2007 (Mayor’s Order 2007 – 246).
The State Advisory Panel on Special Education performs the following functions:
(a) Advise the SEA of unmet needs within the State in the education of children with disabilities;
(b) Comment publicly on any rules or regulations proposed by the State regarding the education of children with disabilities;
(c) Advise the SEA in developing evaluations and reporting on data to the Secretary under section 618 of the Act;
(d) Advise the SEA in developing corrective action plans to address findings identified in Federal monitoring reports under Part B of the Act;
(e) Advise the SEA in developing and implementing policies relating to the coordination of services for children with disabilities.
(f) Advise on the education of eligible students with disabilities who have been convicted as adults and incarcerated in adult prisons;
(g) Provide advice on systemic and other issues affecting the coordination and delivery of special education and related services to children and youth with disabilities;
(h) Review and comment publicly on the State Annual Program Plan;
(i) Undertake any other duties assigned by the Mayor, the OSSE as the SEA or as required by federal law; and
(j) Prepare an annual report of its activities and recommendations on or by July 1 of each calendar year.
The Office of the State Superintendent of Education (OSSE) in its role as the SEA provides administrative, technical support and coordination assistance. The OSSE shares relevant and current information to panel members, serves in an Ex-Officio capacity as a non-voting member, assists with agenda development, reports progress on indicators form the State Performance Plan, supports the panel in carrying on their functions and reports on performance of students with disabilities.
