| Proposed DCMR Title 5, Chapter 30, Section 3030: Resolution Meeting, Due Process Hearing and Final Decision Procedure
The proposed rule sets forth the procedures regarding resolution meetings and due process hearings and decisions following the filing of an administrative due process complaint against a public education agency. A proposed rule was previously published in the DC Register for public comment on May 29, 2009. (See 56 DC Register 4208.). After the thirty (30) day comment period, public hearings were held on the proposed rule as required by the Individuals with Disabilities Education Act, 20 U.S.C. §1400 et seq., 34 C.F.R. §300.165. This re-proposal of the rule takes into account comments made during the prior public comment period and public hearings.
